City of York Council has successfully prosecuted a York man for breaching planning laws and failing to remove a large domestic outbuilding which he had built without permission.
In a case that spans over a period of six-years, Mr Richard Paskauskas, aged 53, of 14 Pasture Lane, York, started to build an 850 square metre single story outbuilding in 2006 without seeking the correct planning permission.
As a result the council served him with a notice to remove the building, which he failed to comply with. Mr Paskauskas unsuccessfully appealed the notice in 2007, and has been involved in a civil case against the firm who represented him at that appeal for the last two-years.
The case was held at York Magistrates Court on Thursday 13 June where Mr Paskauskas pleaded guilty and was given a conditional discharge and ordered to pay costs of £1,640.
Cllr Dave Merrett said: “Prosecuting is always the last resort and the council held off taking action to allow time for matters to be put right. Most people do comply with the law before getting to this stage, but it is not acceptable for people to continue flouting the planning process.
“We will take action where appropriate against those who don’t comply with planning permission.”
Matthew Parkinson, Planning Enforcement and Appeals Team Leader at City of York Council, said: “We will take action against those who don’t comply with planning regulations. However, Mr Paskauskas is now looking to work with the council to bring this matter to a conclusion.”
