City of York Council leader Cllr James Alexander has met with concerned residents to confirm that the council will not be contesting an appeal by McDonald’s against its Blake Street licence review decision and to offer the authority’s continued support to pursue a collaborative approach to tackling late night anti-social behaviour in the area.
Residents submitted an application for a review into the restaurant’s licensing hours in February. However McDonald’s has since appealed the decision of the licensing hearing this month citing specific technicalities.
The restaurant stated that the application was signed by one applicant as a representative signature for all, rather than all six applicants individually signing the application.
The restaurant also appealed on the grounds that the documentation should have been served on all parties on the same day by the applicants, rather than by council officers a day later. The council has not contested this appeal following legal advice and in reviewing similar cases elsewhere.
Cllr James Alexander, leader of City of York Council, said: “McDonald’s has fought its case on a technicality, and we believe the restaurant chain should respect the views of local residents and the city.
“This area of the city is particularly relevant to the work we are doing around the late night economy of York and it is an issue I have raised a number of times in the past.
“In accompanying North Yorkshire police on a late night shift I have personally witnessed the disturbances which take place here and have spoken to police officers who said that they are called to the premises on a regular basis on Friday and Saturday nights.
“I met with concerned residents today and have arranged a meeting with McDonald’s representatives to discuss how we can resolve these issues collectively for the benefit of the city, Blake Street residents in particular, and for McDonald’s.”
