The case against a York barbers accused of operating during the coronavirus lockdown has been dropped.
Q Gentlemen’s Barbers and its directors were due to face trial at York Magistrates’ Court yesterday (Wednesday) for alleged breaches of coronavirus restrictions.
But district judge Adrian Lower decided they had no case to answer and the prosecution offered no evidence.
The case was dismissed after Mr Lower decreed that the prosecution had not carried out a requisite legal procedure in readiness for the trial.
City of York Council, which was prosecuting the case, offered no evidence and all three defendants were formally cleared of all the charges.
Ryan Cross, 31, of Alness Drive, Woodthorpe; Dylan Bell, 28, of Burnholme Drive, Tang Hall: and Q Gentlemen’s Barbers, of Bishopthorpe Road, York, had all denied charges of continuing to operate a business that should have been closed under Tier 4 coronavirus regulations between January and March 2021, failure to shut a business that should have been closed under a different set of coronavirus regulations between 29 March, 2021, and 11 April, 2021, and two allegations of contravening a prohibition order made under coronavirus regulations after 13 May, 2021.
